Terms of Service
1. Who we are
Samrute ("we", "us", "the platform") operates an online marketplace that connects private drivers who are already making a journey with passengers travelling the same way, so they can share the costs of the trip. In these Terms, "member" means any registered user; a "driver" offers a journey and a "passenger" books a seat.
2. What Samrute is — and is not
Samrute is an intermediary technology service only. We help members find each other, agree a cost contribution, communicate, and record their arrangement. We do not:
- provide transport, operate vehicles, or employ or contract drivers;
- guarantee that any journey will take place, depart on time, or arrive;
- set or control the driver's route, conduct, vehicle or availability;
- hold, forward or guarantee the cost contribution paid between members.
The transport arrangement is a private agreement between the driver and the passenger. We are not a party to it and are not a carrier, taxi service or passenger-transport operator.
3. Eligibility and accounts
- You must be at least 18 years old and legally able to enter a contract.
- You must provide accurate information and keep your account secure.
- Some features (for example publishing rides) may require identity verification via MitID and, for drivers, a valid driving licence and vehicle information.
4. Cost-sharing, not profit
Samrute supports genuine cost-sharing. The per-seat contribution a driver may request is limited to a share of the real, directly connected costs of the journey (such as fuel and wear) and is capped by our published contribution policy. A driver must not seek to make a profit from a journey. The cost contribution is settled directly between driver and passenger; we never receive or hold it.
5. Platform fee, bookings and cancellations
- We charge members a separate platform fee for use of the service. This is distinct from the cost contribution.
- A booking is confirmed when the driver accepts and any platform fee is paid.
- Platform-fee refunds follow our cancellation policy, which depends on who cancels and how far before departure. The driver contribution is a matter between the members.
6. Driver responsibilities
If you offer a journey you confirm that you hold a valid driving licence, that your vehicle is roadworthy and legally insured for carrying passengers in a cost-sharing arrangement, and that you comply with all applicable traffic, tax and insurance law. You are responsible for confirming your insurance covers cost-shared passengers.
7. Conduct, safety and moderation
You agree to treat other members with respect, provide accurate information, and not use the platform for anything unlawful, discriminatory, or off-platform payment solicitation. We operate ratings, reporting, blocking and moderation, and may suspend or remove accounts that breach these Terms, with reasons and a right of appeal.
8. Taxes and DAC7
You are responsible for your own tax obligations. As an online platform we may be required to collect seller information and report certain activity to the Danish tax authorities under EU rules (DAC7). By using the service as a driver you agree to provide the information needed for this reporting.
9. Liability
To the maximum extent permitted by Danish law, Samrute is not liable for the acts, omissions, conduct, vehicle condition, driving, punctuality or safety of any member, nor for any loss arising from a journey. Nothing in these Terms excludes liability that cannot be excluded by law, including mandatory consumer rights.
10. Intellectual property
The platform, its software, brand and content are owned by Samrute or its licensors and may not be copied or reused except as permitted by law.
11. Suspension and termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, for safety, or where required by law, following a fair process.
12. Changes
We may update these Terms. We will notify members of material changes and show the date of the latest version. Continued use after changes means you accept them.
13. Governing law and disputes
These Terms are governed by Danish law. Mandatory consumer-protection rights remain unaffected, and consumers may use the EU Online Dispute Resolution platform.
